Terms and Conditions

1. General Terms of Service

These Terms and Conditions ("Terms") govern the use of services provided by Eagle Heating and Air ("Company," "we," "us," or "our"), a heating, ventilation, and air conditioning (HVAC) service company based in Boise, Idaho. By engaging our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

Eagle Heating and Air is a licensed HVAC contractor in the State of Idaho, Contractor License #6971551. We are fully bonded, insured, and EPA certified.

2. Services

We provide residential and commercial HVAC services including, but not limited to, installation, repair, maintenance, inspection, and emergency services. All services are performed by qualified, licensed technicians in accordance with applicable local, state, and federal codes and regulations.

3. Estimates and Pricing

All estimates provided are based on our initial assessment and are subject to change if additional issues or requirements are discovered during the course of work. We will communicate any changes to pricing before proceeding with additional work. Written estimates are valid for 30 days unless otherwise stated.

4. Scheduling and Cancellation

Service appointments are scheduled based on availability. We make every effort to arrive within the scheduled time window. If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Repeated no-shows or last-minute cancellations may result in a service fee.

Emergency services are available 24/7 and are subject to availability and standard emergency service rates.

5. Payment Terms

Payment is due upon completion of services unless otherwise agreed upon in writing. We accept cash, check, and major credit cards. Financing options may be available for qualifying customers and projects. Past-due balances may be subject to late fees and collection activities.

6. Warranty and Guarantees

We stand behind our workmanship. Labor warranties vary by service type and will be communicated at the time of service. Manufacturer warranties on equipment and parts are separate from our labor warranty and are subject to the manufacturer's terms and conditions. Warranty claims must be reported promptly.

7. Warranty Disclaimers

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL RESOLVE ALL ISSUES WITH YOUR HVAC SYSTEM, PARTICULARLY IN CASES OF AGING EQUIPMENT, IMPROPER PRIOR INSTALLATION, OR PRE-EXISTING CONDITIONS NOT IDENTIFIED DURING OUR INITIAL ASSESSMENT.

8. Limitation of Liability

To the maximum extent permitted by Idaho law, Eagle Heating and Air's total liability for any claim arising from our services shall not exceed the amount paid by the Customer for the specific service giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

9. Customer Responsibilities

Customers are responsible for providing safe and reasonable access to HVAC equipment and work areas. Customers must disclose any known hazards, pre-existing conditions, or relevant information about their HVAC systems. Failure to provide safe access may result in rescheduling or additional charges.

10. Eagle Care Club Membership

Eagle Care Club memberships are subject to their own specific terms, including pricing, benefits, cancellation policies, and renewal terms. Membership benefits cannot be transferred and apply only to the property and systems specified at the time of enrollment.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, disputes shall be resolved through mediation or arbitration in Ada County, Idaho.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of laws provisions.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
